The question remains what does The Trinity Church’s non-disclosure agreement look like and what constraints does it have? Inside evangelicalism today non-disclosure agreements have been embraced by many ministries and mega churches. Here in the Washington, D.C. area I am on a personal quest to obtain some of the non-disclosure agreements that local churches use to illustrate how churches are following more of a business model.  In the first Mars Hill saga Warren Cole Smith obtained the non-disclosure agreement used which you can read about in, “Sign or face the consequences.” Warren Throckmorton also obtained the non-disclosure agreement used and wrote about it in, “A Former Mars Hill Pastor Speaks Out and Why Others Are Afraid: The Mars Hill Church Non-Disclosure Agreement.” The non-disclosure agreement is often used to silence people. When I was writing about the Harvest Bible Chapel scandal with James MacDonald one of more sources who was plugged into Harvest obtained for me one of the alleged non-disclosure agreement used. OVERVIEW

Because of the nature of the work that you do, you may have access  to information of a confidential nature. This information should not be discussed except with authorized personnel. The unauthorized disclosure of confidential information will result on the immediate cessation of your volunteer work. If any situation arises about which you have a question see a Trinity Church staff member immediately. We must protect the church family and guests’ personal information. Trinity Church volunteers are expected to abide by these confidentiality standards during their volunteer period. This confidentially agreement is also expected to be carried out by former volunteers, and any violation of such can result in being asked not to participate in the life of the Trinity Church family. 

Confidential information includes but is not limited to all personal information related to 1) church family and church guests, including contribution history, serving records, contact information, appointments made with pastors, information discussed during meetings and 2) information in regards to The Trinity Church business operations and staffing matters. 

AGREEMENT

I agree to protect the confidentiality of all information concerning The Trinity Church’s business operations, staff, volunteers and guests. 

In addition I understand and agree that my compliance with the obligations herein is a condition to any volunteer position with The trinity Church that has access to any private information.

Some Observations on This Non-Disclosure Agreement

In my years of involvement in evangelicalism from 1999 until about 2017 when I volunteered I was never asked to sign such an agreement. You can find confidentially agreements with companies that involve trade secrets, such as pharmaceutical companies, defense contractors, and other companies that have invented brands that have given lift to the company. Think of some of the formulas that DuPont has invented and you will get my drift. Non-disclosure agreements are used by local, state and federal governments. Non-disclosure agreements are void in the case of criminal activity and misdemeanors and felonies. Mark Driscoll seems to think he is protected through this agreement. In the view of this blog this non-disclosure agreement is garbage and chances are it was written by someone who Mark Driscoll or even Robert Morris trusts.   2. There’s no consideration, thus it’s not a contract and not binding. It’s also missing signatures from someone who can sign on behalf of The Trinity Church (which would be Mark Driscoll), so also not a contract. I’m not going to give Driscoll any help on figuring out what a consideration is, or how to put together a binding Non-Disclosure Agreement. If he wants that, he can pay a lawyer. Oh, and Mark, if you want binding NDAs, you have to PAY for them. You know, with MONEY.

    To anyone who may have signed this piece of garbage, it’s worthless, not even worth the electrons it’s using on my screen.

      • Of course not! But seriously, all those high falutin’ words are just designed to scare people into keeping their mouths shut. It looks scary, but it’s not. It doesn’t even have the pretense of being legal, like Cosby’s NDAs.

  3. With all due respect, the first half of the NDA makes sense:

    “church family and church guests, including contribution history, serving records, contact information, appointments made with pastors, information discussed during meetings.”

    My own church has a handshake agreement that we keep such information confidential due to the priest-penitent laws of the Commonwealth of Pennsylvania and the privacy laws of the Federal Government. Making such information public could result in a lawsuit.

    However, the second part of the agreement is complete garbage. A 501(c)3 is obligated to be transparent and the second part, “information in regards to The Trinity Church business operations and staffing matters” is unenforceable due to the anonymity provided by organizations desiring such information. And why would they be confidential anyway? It makes no sense.

    Anyway, the whole NDA is worthless when it comes to exposing crimes especially those against minors that are required to be reported by all states.

    • My issue with this is that it’s not a contract. There’s no consideration and a representative of The Trinity Church has not signed it. They can throw in all sorts of legalese, but I can make a very good argument that it’s not a contract.

      Even if it could be construed as a contract, it does appear that if Driscoll tosses someone out, the agreement ends. *shrug*
